These Terms of Use ("Terms") govern your access to and use of the Cakeping website at cakep.ing, the Cakeping mobile application, and any related services (collectively, the "Service"), operated by AppMixo Lab LLP (Surat, Gujarat, India), a subsidiary of AppMixo INC (16192 Coastal Highway, Lewes, DE 19958, USA) ("Cakeping", "we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Nothing in these Terms grants you a licence to use our intellectual property other than as strictly necessary to view the Service for its intended purpose.

Cake design ideas, images, and descriptions on the Service are for inspirational purposes only. We make no guarantee as to the accuracy or completeness of any content, nor do we take responsibility for how the designs are reproduced by third parties.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAKEPING, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED INR 1,000 (ONE THOUSAND INDIAN RUPEES) OR USD 10 (TEN US DOLLARS), WHICHEVER IS GREATER.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in accordance with the rules of JAMS, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
